  6.                      PATENTS IN BRIEF
  7.  
  8.      A patent is a grant issued by the United States Government
  9. giving an inventor the right to exclude all others from making,
  10. using, or selling the invention within the United States, its
  11. territories and possessions.
  12.  
  13.      There are three kinds of patents: (1) UTILITY PATENTS, granted
  14. to the inventor or discoverer of any new and useful process,
  15. machine, manufacture, composition of matter, or any new and useful
  16. improvement thereof; (2) PLANT PATENTS, granted on any distinct and
  17. new variety of asexually reproduced plant; (3) DESIGN  PATENTS,
  18. granted on any new, original, and ornamental design for an article
  19. of manufacture.

  21.      Utility and plant patents are effective for 17 years from the
  22. date the patent granted, and only utility patents are subject to
  23. the payment of maintenance fees; design patents are effective for
  24. 14 years.  Patents may be extended only by special act of Congress,
  25. except for some pharmaceutical patents whose term may be extended
  26. to make up form time lost due to Government-required testing.

  28.      The basic fee for filing an application for a utility patent
  29. ranges from $315 to $630, dependent upon whether or not the
  30. applicant is entitled to status as a small entity (independent
  31. inventor, small business concern or non-profit organization).
  32. Issue fees for utility patents range from $525 to $1050.
  33. Maintenance fees are due at 3 1/5, 7 1/2 and 11 1/2 years from the
  34. date the utility patent is granted.

  36.      Applications are assigned to examiners who are experts in
  37. various fields of technology.  They research previous patents and
  38. technical literature to determine whether a patent should be
  39. granted.  This procedure takes an average about 18 months.

  41.      If you plan to file an application, you or your representative
  42. are advised to make a search of patents previously granted and
  43. printed publications to make sure that your idea has not already
  44. been patented or disclosed.  You may do this at the Public Search
  45. Room of the Patent and Trademark Office, Crystal Plaza Building No.
  46. 3, 2021 Jefferson Davis Highway, Arlington, Virginia.  Hours are 8
  47. a.m. to 8 p.m. Monday through Friday except holidays.  More limited
  48. searches may be made at Patent and Trademark Depository Libraries
  49. located throughout the United States.

  51.      The Patent and Trademark Office strongly advises you to
  52. consult a registered patent attorney or agent before attempting to
  53. file an application.  Names of patent attorneys and agents may be
  54. obtained from classified telephone directories in major cities, or
  55. from a directory published by the Government Printing Office.
